1. Acceptance and Scope of Agreement
By accessing, browsing, or utilizing the Bamboo
Maturity Index evaluation tool ("the Tool"), you
expressly acknowledge that you have read,
understood, and unequivocally agree to be bound by
these comprehensive Terms and Conditions. If you do
not agree with any part of these terms, you must
immediately cease use of the Tool.
2. Nature of Service & "Not Professional Advice"
The Tool provides an automated, self-reported
algorithmic estimation of technology maturity. It is
strictly for internal, informational, and strategic
guidance purposes only. The output, score, and
scores do not constitute formal
legal, financial, architectural, cybersecurity, or
compliance certification (including but not limited
to ISO, SOC 2, HIPAA, PCI-DSS, or GDPR). Shelfgrow
does not act as your auditor, legal counsel, or
certified consultant.
3. Complete Disclaimer of Warranties
The Tool and all generated outputs are provided on
an "AS IS" and "AS AVAILABLE" basis, without any
warranties of any kind, either express or implied.
Shelfgrow expressly disclaims all warranties,
including but not limited to implied warranties of
merchantability, fitness for a particular purpose,
accuracy, completeness, and non-infringement. We do
not guarantee that the Tool is error-free or that
its algorithms perfectly reflect true enterprise
risk.
4. Absolute Limitation of Liability
To the maximum extent permitted by applicable global
law, under no circumstances shall Shelfgrow, its
affiliates, directors, employees, or agents be held
liable for any direct, indirect, incidental,
consequential, special, punitive, or exemplary
damages arising out of or in connection with your
use of the Tool. This includes, without limitation,
loss of profits, business interruption, data
breaches, regulatory fines, or reliance on the
Tool's output for business decisions, even if
Shelfgrow has been advised of the possibility of
such damages.
5. User Indemnification
You agree to fully indemnify, defend, and hold
harmless Shelfgrow and its officers, agents, and
employees from and against any and all claims,
liabilities, damages, losses, costs, and expenses
(including reasonable legal fees) arising from your
use of the Tool, your reliance on its results, your
violation of these Terms, or your infringement of
any third-party rights or global regulatory
frameworks.
6. Global Data Privacy & Communications
We process basic professional data (Name, Email,
Company, Role) to generate and email your BMI,
deliver the requested service, and send periodic
relevant updates from Shelfgrow, relying on your
explicit consent and our legitimate business
interests. We implement commercially reasonable
security measures and
do not sell your data. By entering
your data and opting in, you explicitly consent to
receive your BMI and ongoing communications via
email. You retain all rights to unsubscribe, request
access, rectification, or deletion of your data
under applicable privacy laws by contacting our
administration.
7. Intellectual Property Rights
The assessment framework, proprietary scoring
algorithms, user interface, and index score design
are the exclusive intellectual property of
Shelfgrow. You are granted a revocable, limited,
non-exclusive right to use the generated output
solely for your internal organizational review. You
may not reverse-engineer, sell, or commercially
distribute the Tool's underlying methodology.
8. Severability & Governing Law
If any provision of these Terms is found to be
unenforceable or invalid under any applicable law,
such unenforceability or invalidity shall not render
these Terms unenforceable or invalid as a whole.
These terms shall be governed by and construed in
accordance with applicable standard commercial law,
without regard to conflict of law principles.
